1. About the Service

replacephoto.com ("the Site", "we", "us") is a website where any user can pay €1 to replace the single photo displayed on the homepage. Each successful payment replaces the previously active photo. The service is operated as an independent project.

2. Payments

The price to replace the current photo is €1.00, processed securely via Stripe. By completing a payment you agree to Stripe's Terms of Service.

Payments are non-refundable. Once your payment is confirmed and your photo goes live on the homepage, the transaction is complete. If your photo is replaced by a subsequent user, no refund or compensation is owed.

We reserve the right to cancel a payment and refund a user if their uploaded image violates these Terms (see Section 4). In that case, the previous live photo may be restored at our discretion.

3. User-Uploaded Content

By uploading an image, you confirm that:

• You own the image or have the right to use and publicly display it.
• The image does not infringe the copyright, trademark, privacy, or any other rights of a third party.
• You grant replacephoto.com a non-exclusive, worldwide, royalty-free licence to display the image on the homepage until it is replaced.

We do not claim ownership of your image. After your photo is replaced it is deleted from our storage within a reasonable timeframe.

4. Prohibited Content

You may not upload images that:

• Contain nudity, pornography, or sexually explicit material.
• Depict or promote violence, self-harm, terrorism, or illegal activity.
• Constitute hate speech or discriminate against any person or group on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Violate the privacy of any individual (e.g. non-consensual intimate imagery, doxxing material).
• Infringe third-party intellectual property rights.
• Are otherwise unlawful in Spain or the European Union.

We reserve the right to remove any image at our sole discretion and to ban users who repeatedly violate these rules.

5. Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or that your photo will remain live for any particular duration. We are not liable for any damages arising from the use or inability to use the Site.

6. Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the new Terms.

7. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
